Terms & Conditions — The Marketing Chicken

1. Services

Unless otherwise stated, all services are billed on a monthly basis. At the end of each month—or upon completion of the contracted service period—you will be issued an invoice. Payment is due within 28 days of receipt. A full price list is available upon request; these prices serve as a general guide to the services offered. All services require a preliminary consultation, which must be booked in advance.

Throughout your service period, you may contact me to request adjustments to your plan to better support the needs of your business. Please note that an early termination fee may apply if you choose to cancel services before the agreed end date. This fee is determined at the discretion of The Marketing Chicken and is non-negotiable.


2. Scope of Work & Revisions

The scope of work will be agreed during your consultation and confirmed before services commence. Any work requested outside the agreed scope may result in additional charges. Unless otherwise stated, services include one round of revisions; further revisions will be billed at the standard hourly rate.


3. Payment Terms, Late Fees & Deposits

If payment is not received within 28 days of the invoice date, The Marketing Chicken reserves the right to suspend all services until payment is made. Late invoices may incur a fixed late fee or statutory interest as permitted by law.

Certain services may require a non-refundable deposit, which will be deducted from the final invoice. Refunds are not available for services already delivered or for work that has commenced, unless otherwise required by law.


4. Client Responsibilities

To ensure the smooth delivery of services, you are responsible for providing all necessary information, access, approvals, materials, or content in a timely manner. Delays in providing such materials may extend delivery timelines or incur additional charges.


5. Photography & Location Requirements

Photography services may involve additional travel or location-related costs, which will be clearly stated as part of your agreement. I reserve the right to decline or discontinue photography services if the location is unsafe, unsuitable, or outside the agreed scope. Any identifiable individuals featured in photographic content may be required to sign a model release form. Where required, a copy of my Public Liability Insurance (PLI) certificate will be provided at photoshoots.


6. License & Intellectual Property

All visual content and photography produced by The Marketing Chicken for your business or project is provided under a shared usage licence. This permits both you and The Marketing Chicken to use the imagery indefinitely for marketing, promotional, and portfolio purposes.

You are not permitted to:

  • Edit, alter, or apply filters to the imagery without prior approval.
  • Use the imagery within or on behalf of another business or entity without prior discussion and agreement.

All intellectual property rights remain the property of The Marketing Chicken unless expressly transferred in writing.


7. Turnaround Times & Delays

Estimated timelines will be provided where possible, but these are not guaranteed. The Marketing Chicken is not responsible for delays caused by late client communication, missing materials, technical issues, or other circumstances beyond reasonable control.


8. Contract Requirements

You may be required to sign a contractual agreement prior to the commencement of services. This agreement allows me to hold you accountable if payment is not made. If you refuse to sign a contract and I reasonably believe that providing services would result in financial loss, I reserve the right to refuse service.


9. Limitation of Liability

The Marketing Chicken is not liable for any indirect, incidental, or consequential loss, including but not limited to: loss of revenue, profit, business, or opportunities arising from the use of services or content provided. No specific results, growth outcomes, or performance indicators are guaranteed.


10. Force Majeure

The Marketing Chicken will not be held liable for delays, interruptions, or failure to fulfil obligations due to events beyond reasonable control, including but not limited to illness, accidents, system failures, extreme weather, or other unforeseeable circumstances.


11. Communication Policy

Communication will primarily take place via email or another mutually agreed method. Typical response times are within 48 hours on business days. Messages sent outside working hours may be responded to on the next business day.


12. Privacy

The Marketing Chicken is committed to maintaining your privacy. Personal details will not be shared on business platforms. Your personal data is stored only for administrative, legal, or security purposes. You have the right to request deletion of your personal data from my records, and such requests will be fulfilled in accordance with GDPR regulations.


Agreement

By entering into a service agreement with The Marketing Chicken, you acknowledge and agree to the Terms and Conditions outlined above.
